legalisation on rural land

Illegal buildings on rural land in the Balearic Islands built before May 29, 2014 may be legalized if are not in High Protected Areas.

The Balearic Government has approved an extraordinary regularization of out of order constructions that will allow to legalize the constructions in rustic land as long as they are prescribed. That is to say, as long as the administration can no longer order demolition.
In order to do so, they cannot have an open file for administrative infringement.
The infraction must have been committed before May 23, 2016 in common rustic land, before May 29, 2014 for use infringements, if it is in protected rustic land or before March 10th 1991 if constructions are in the areas included in the Law of Natural Spaces.

Therefore there are 3 key dates
May 2016 for common rustic
May 2014 is the key date for use infringements.
March 1991 for areas under the Law of Natural Spaces

Thousands of offenders missed the opportunity under the previous amnesty because they DID NOT KNOW that their property was illegal.

In exchange for obtaining the legalization the owners will have to pay an economic consideration and to implement environmental measures. ¿How much will cost?

The following properties CANNOT be legalized
.-The constructions whose infringement has not prescribed / time barred. (The time has not passed, or having passed the time, they have an open file).
.-Buildings subject to expropriation,
obligatory and free cession or demolition.

.-The buildings, located in the public domain, in the zone of protection of the highways or in the easements derived from the legislation of coasts.

.-Those that require for their activity the acquisition of places, quotas or other rights of public and limited character, as it is the case of rural hotels or agrotourism.
.-Those subject to the previous declaration of general interest.
