The cost to legalise a property in Balearic has been included in the regulation approved by the Balearic government in May 2024.
As you will see below, the cost to legalise a property in the Balearic Islands is not fixed and depends on several factors. Value of the construction, when it is legalised (the later it is legalised, the more expensive it is) and the economic capacity of the offender.
Before going into the costs of legalising a property in the Balearic Islands, it is important to be sure that the property is legalisable.
The extraordinary measure does NOT allow you to legalise any property. Only some of the ilegal properties in rustic land are elegibles.
Penalty Costs to legalise property in Balearic
Offenders will have to pay the same planning fees that are required to build a property. In addition they will have to pay a rate of 10 % if they legalise during the first year of this procedure, 12.5 % if it is requested in the second year and 15 % if it is requested in the third year.
Reductions: 50 % for applicants subject to personal income tax, in the case of taxpayers whose total taxable income, calculated on the average for the last four tax years, does not exceed EUR 33,000 in the case of individual taxation or EUR 52,800 in the case of joint taxation; and 25 % in the case of applicants subject to personal income tax, in the case of taxpayers whose total taxable income, calculated on the average for the last four tax years, does not exceed EUR 33,000. 33,000 in the case of individual taxation or 52,800 euros in the case of joint taxation; and 25 % when this base does not exceed 52,800 euros in the case of individual taxation or 84,480 euros in the case of joint taxation.
Other Costs to legalise a property in Balearic
LAWYER /ARCHITECT: The first to do is to hire a professional town planning expert, a lawyer or architect registered in Spain with knowledge of the Balearic regulations, to check whether legalisation is possible. This is IMPORTANT. If you present a legalisation project and it is not possible, the administration will know that your house is illegal.
PROJECT: A technical project will be required for the adaptation to environmental sustainability criteria with measures that involve a reduction in light pollution and an increase in the energy or water efficiency of the building, construction or installation through the use of materials, techniques and construction systems, change of installations, generation of renewable energy, installation of water tanks or any other system to reduce the energy or water consumption of the network, and also water purification systems appropriate in each case in the Hydrological Plan of the Balearic Islands.
