Is the urban amnesty about to be approved in Mallorca so the Balearic Islands?

The urban amnesty in rustic land that could be approved in Mallorca, and all Balearic Islands, was one of the electoral promises of the party rulling the Balearic Islands (PP).
Rumors echoed in the local press suggest the regulation could be approved imminently.

Is it certain that the urban amnesty will be approved in Mallorca?

It is not sure amnesty will happens, so we must be cautious. Especially those buyers who are being pushed to buy illegal houses with the “promise” that the government will surely approve the new rule. Said this, rumors seem to be well founded. In any case, NOT ALL illegal properties will be able to be legalized. Only some of them.

Are the conditions known for the urban amnesty to be approved in Mallorca?

They are NOT known yet, but it seems clear that if the amnesty is approved in rustic land, it will only be for constructions whose infringement is time-barred / prescribed. (Notice. The statute of limitations implies; not being in a protected zone, that 8 years have passed since the construction was finished and that there is no open file, whether the owner knows it or not)


Nothing is yet known about other conditions such as fines, taxes or energy improvement requirements or others.

Do the owners know that their property is illegal?

No. In 2014 the so called Company law (not in force anymore) allowed the legalization of properties on rural land. Many did not take advantage of the opportunity because they believed their house was legal.
That is why now, -with the rumors of a new urban amnesty that could be approved in Mallorca- it is essential that an expert audits the property to know if it complies with the urban planning legality.

The fact that it has been bought before a notary, is registered in the land registry, appears in the land cadaster, pays taxes and even has a certificate of occupancy DOES NOT MEAN that it is legal.

Nowadays the urban amnesty is still a rumor, the advice is to audit your property ASAP to know if it complies with the urban planning.
Discovering that you have an illegal house is bad news.
Discovering it when the regulations that allowed it to be legalized no longer apply is even worse news.
